1. Introduction and Acceptance

These Terms of Service govern your access to and use of Kimrel ("we," "our," or the "Service"), including our website, chat features, API access, and related tools.

Kimrel is an independent platform that provides a custom interface and related tooling for third-party AI models. Our Service may provide access to models including Kimi K2, which is developed by Moonshot AI. Kimrel is not affiliated with, endorsed by, or sponsored by Moonshot AI, and we are not the developer, owner, or operator of the Kimi K2 model itself.

By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, you must not use the Service.

2. The Service

The Service may include:

• AI-powered chat features
• API access and developer tooling
• Usage-based credits, subscriptions, or other billing mechanisms
• Guest or trial access where offered

We may modify, improve, suspend, or discontinue parts of the Service from time to time.

3. Accounts, Access, and Security

You may need an account to use certain parts of the Service. If you create an account or generate API credentials, you agree to:

• provide accurate and current information
• keep your login credentials and API keys confidential
• remain responsible for activity occurring under your account or credentials
• notify us promptly if you suspect unauthorized access or misuse

We may suspend or restrict access if we reasonably believe your account, credentials, or usage pose a security, fraud, abuse, or legal risk.

4. Acceptable Use

You agree not to use the Service to:

• violate any applicable law or regulation
• infringe the rights of others, including intellectual property, privacy, publicity, or contractual rights
• generate, submit, or distribute NSFW, unlawful, fraudulent, deceptive, abusive, hateful, sexually explicit, or otherwise harmful content
• attempt to bypass safety systems, abuse rate limits, or disrupt the Service
• reverse engineer, probe, scrape, or interfere with infrastructure or systems except as expressly permitted by law
• share, resell, or misuse accounts, subscriptions, or API credentials in unauthorized ways
• use the Service in any way that could expose us, our users, or our providers to legal, security, or operational harm

You are responsible for the content you submit and for how you use outputs generated through the Service.

5. Your Content and Outputs

As between you and us, you retain rights you may have in content you submit to the Service, subject to any rights necessary for us and our service providers to operate, maintain, secure, and improve the Service.

You are responsible for reviewing and evaluating outputs generated through the Service before relying on them. AI outputs may be inaccurate, incomplete, biased, or unsuitable for your intended purpose.

You must not represent outputs in a misleading manner or use them in contexts where errors could create material harm without appropriate human review and safeguards.

6. Third-Party AI Models and Providers

To provide functionality, the Service may route prompts, conversation content, request metadata, and related technical information to third-party AI model or inference providers.

This may include support for Kimi K2, which is developed by Moonshot AI. We provide an independent interface and related tools around such models, but we do not own or control the Kimi K2 model itself and are not affiliated with Moonshot AI.

Your use of model-backed features may also be subject to provider-side availability, limitations, policies, or technical constraints outside our direct control.

7. Billing, Credits, and Payments

If you purchase credits, subscriptions, or paid access:

• you agree to pay all applicable fees, taxes, and charges
• pricing, included usage, and billing terms are governed by the plan or offer presented at checkout or in the Service
• payments may be processed by third-party payment providers such as Creem or Stripe
• failure to pay or chargeback activity may result in suspension or termination of access, subject to applicable law

Unless otherwise stated, fees are non-refundable except where required by law or expressly provided by an applicable refund policy.

8. Availability and Disclaimers

The Service is provided on an "as is" and "as available" basis.

To the maximum extent permitted by law, we disclaim all warranties, whether express, implied, statutory, or otherwise, including warranties of merchantability, fitness for a particular purpose, non-infringement, availability, accuracy, or reliability.

We do not guarantee that:

• the Service will be uninterrupted, secure, or error-free
• outputs will be accurate, complete, or suitable for any specific purpose
• any third-party model or provider will remain available

9. Limitation of Liability

To the maximum extent permitted by law, Kimrel and its operators, affiliates, service providers, and licensors will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenues, data, goodwill, or business opportunities arising out of or related to your use of the Service.

To the maximum extent permitted by law, our total liability for all claims arising out of or relating to the Service will not exceed the greater of:

• the amount you paid us for the Service in the 12 months before the event giving rise to the claim; or
• USD $100

Some jurisdictions do not allow certain limitations of liability, so some of the above limitations may not apply to you.

10. Indemnification

You agree to defend, indemnify, and hold harmless Kimrel, its operators, affiliates, service providers, and licensors from and against claims, liabilities, damages, judgments, losses, costs, and expenses (including reasonable legal fees) arising out of or related to:

• your use of the Service
• your content, prompts, requests, or outputs-related use
• your violation of these Terms
• your violation of law or the rights of any third party

11. Suspension and Termination

You may stop using the Service at any time.

We may suspend, limit, or terminate access to the Service, with or without notice where appropriate, if we reasonably believe:

• you violated these Terms or applicable law
• your use creates security, fraud, abuse, or legal risk
• continued access could harm the Service, other users, or third-party providers

Sections that by their nature should survive termination will survive, including provisions regarding payment obligations, disclaimers, limitations of liability, indemnification, governing law, and dispute-related terms.

12. Governing Law

These Terms are governed by the laws of the jurisdiction in which Kimrel operates, without regard to conflict-of-law rules, except to the extent otherwise required by applicable law.

13. Changes to These Terms

We may update these Terms from time to time. When we do, we will post the updated version on this page and revise the date above. Your continued use of the Service after updated Terms become effective constitutes acceptance of the revised Terms.
